These Terms and Conditions (the "Terms") govern access to and use of the Omanero platform (the "Service"), owned by Omanero Technologies, S.L. ("Omanero", "we"), tax ID B-XXXXXXXX, registered in Madrid (Spain). Using the Service means full acceptance of these Terms. If you do not agree, you must not use the Service.
1. Purpose of the Service
Omanero is a technology platform that connects users with third-party affiliate programs of crypto exchanges, brokers and financial services ("Partners") and, where applicable, returns to users part of the affiliate commissions Omanero receives ("cashback").
Omanero is not an exchange, broker, financial, payment or investment institution, nor a financial adviser. Omanero does not custody user trading funds, execute trades or manage investments. The trading or investment relationship is solely between the user and the relevant Partner.
2. Eligibility and account
To use the Service you must be of legal age and have capacity to contract. You are responsible for the accuracy of the data you provide, the confidentiality of your credentials and all activity under your account. Omanero may request identity-verification information where necessary to comply with legal obligations or prevent fraud.
3. Nature of cashback
Cashback is a promotional, voluntary reward, not a guaranteed consideration. In particular:
- All amounts shown are provisional and estimated until finally validated by Omanero.
- Calculations depend on information Partners report to Omanero; Omanero does not guarantee its accuracy or availability.
- Omanero may carry out manual reviews and anti-fraud checks before confirming or paying any amount.
- Calculation, payment, minimums and timeframes are governed by the Cashback and Payments Policy.
4. Modification, suspension and cancellation
Omanero reserves the right, at any time and at its sole discretion, to modify, suspend, limit or cancel, in whole or in part, the Service, promotions, cashback programs, applicable percentages, available Partners and their conditions, without this giving rise to any compensation. Where a change affects users' already-consolidated rights, Omanero will endeavour to give reasonable prior notice.
5. Acceptable use
You agree not to use the Service fraudulently or abusively, not to create multiple accounts to obtain undue rewards, not to manipulate tracking or the referral system, and not to breach Partner terms. Breach entitles Omanero to apply the measures in the Anti-Fraud and Abuse Policy, including cancelling rewards and closing the account.
6. Intellectual property
The Service, its software, design, trademarks and content are owned by Omanero or its licensors and protected by intellectual and industrial property law. No licence is granted beyond that strictly necessary to use the Service.
7. Limitation of liability
To the maximum extent permitted by law, Omanero shall not be liable for: (i) the user's trading or investment decisions or losses; (ii) the availability, conditions, fees or conduct of Partners; (iii) errors, delays or failure by third parties to report data; (iv) regulatory changes affecting the Service or Partners; (v) interruptions, technical errors, attacks or unavailability of the Service; or (vi) indirect damages, loss of profit or loss of opportunity. Omanero's total liability, if any, shall be limited to the cashback actually confirmed and pending payment to the affected user.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including consumer rights.
8. Data protection
The processing of your personal data is governed by the Privacy Policy and the Cookie Policy.
9. Term and termination
You may stop using the Service and request closure of your account at any time. Omanero may suspend or cancel your access in the event of breach of these Terms or applicable policies.
10. Governing law and jurisdiction
These Terms are governed by Spanish law and applicable European Union law. For disputes, the parties submit to the courts of the consumer's domicile where consumer law so requires; failing that, to the courts of Madrid. Consumers may also use the European online dispute resolution platform.
11. Changes to the Terms
Omanero may update these Terms. The version in force is the one published on this page, stating its update date. Continued use of the Service after an update implies acceptance.
